2 Attribution

You agree that any application or service that incorporates data obtained from the Service shall prominently display the message "Source: CRA-W" in a legible manner near the data or any information derived from any data in the Service. This message should, if possible, open a link to https://bcgms.be/ when clicked or touched. You may not display or invoke the name or logo of the Service or Bcgms.be in any manner that implies a relationship or affiliation with, sponsorship, promotion or endorsement by Bcgms.be, except as permitted by these Terms of Use.

Subject to these Terms of Use, Bcgms.be grants you a limited, non-exclusive, non-assignable, non-sublicensable, non-transferable, revocable, worldwide license for the licensee's personal or commercial use:

•     make calls to the Service to retrieve data from the Service;
•     use, transmit and display data retrieved from the Service in a manner consistent with the terms of these Terms of Use.

Your authorisation to use the Service is subject to your agreement that you will not:

•     use the service in a way that is incompatible with applicable law;
•     create multiple accounts or use any script or other automated tool that attempts to create multiple accounts;
•     provide inaccurate identification, contact or other information required as part of the registration process;
•     sell, rent or sublicense the service or access to it;
•     access, alter or use any non-public area of our Service without authorization;
•     interfere or attempt to interfere with the proper working of the Service;
•     circumvent or disable any security or technological features of the Service.

Bcgms.be respects the privacy of its users. Please refer to our privacy policy, which explains how we collect, use and disclose information relating to your private life.

Bcgms.be retains all right, title and interest in and to the Service, including, without limitation, software, images, text, graphics, illustrations, logos, service marks, copyrights, photographs, video, music and all related intellectual property rights, unless explicitly stated otherwise.

The Service code is licensed under the GNU GPL v3.

If you wish to file a claim against us, you agree to file and settle such claim exclusively in a court located in the Walloon region (Belgium).

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. WE PROVIDE THE SERVICE ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND WE EXPRESSLY DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL MEET YOUR REQUIREMENTS, BE SAFE, SECURE, UNINTERRUPTED, TIMELY, ACCURATE OR ERROR-FREE, OR THAT YOUR INFORMATION WILL BE SECURE.

THE SERVICE AND THE DATA PROVIDED BY THE SERVICE ARE NOT INTENDED FOR USE IN ANY APPLICATION WHERE HUMAN LIFE OR PROPERTY MAY BE AT RISK, YOU WAIVE ANY CLAIM FOR LIABILITY OR DAMAGES FOR SUCH USE. Bcgms. be SHALL NOT BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, CUSTOMERS, USE, DATA OR OTHER INTANGIBLE LOSSES, WHETHER OR NOT YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You shall indemnify and hold Bcgms.be harmless from and against any and all claims and liabilities (including third party claims) and costs and expenses (including attorneys' fees) arising therefrom or in connection with the establishment of the right to indemnification, for injury to or death of any person, including your employees, if any, resulting from your breach of the terms of this license and/or your use of the Service, whether or not in tort or caused by the negligence of Bcgms. be, except to the extent of any obligation, liability, claim or remedy in tort due to the recklessness or willful misconduct of Bcgms.be. Your obligations under this indemnity shall survive the expiration, termination, completion or cancellation of these Terms of Use.

Either party may terminate these terms of use at any time and for any reason.

Upon termination of these Terms of Use, you :

•     acknowledge and agree that all licences and rights to use the Service and data obtained from the Service will terminate,
•     cease all use of the Service,
•     delete all data obtained from the Service from all hard drives, networks and other storage media and destroy all copies of all data obtained from the Service in your possession or control.

You further agree to pay all outstanding charges incurred prior to termination of these Terms of Use.

The sections entitled Payments, Jurisdiction over Disputes, Disclaimers, Limitation of Liability, Indemnification and General Provisions shall survive the termination of these Terms of Use.

These terms of use are effective from 31 March 2021.

These terms of use may be updated from time to time for any reason. We will notify you of any changes to our terms of use by publishing the new terms of use here. We advise you to check these terms of use regularly for any changes, as continued use is deemed to be acceptance of all changes.
